Provisions on Complicity in the Criminal Code 2015 and Practical Issues

Abstract

Crime committed in the form of complicity causes serious consequences for society. Simultaneously, such crimes are easier to evade and conceal, making them more difficult for the authorities to detect. Based on evaluating the current provisions on complicity in the Criminal Code 2015 (amended in 2017), the article clarifies a number of theoretical issues regarding complicity and proposes legal solutions to practical problems. These solutions shall contribute to establishing a solid legal basis to prevent and combat crime in the form of complicity, including its special forms - “organized crime”- an urgent requirement in the forthcoming period.
