Abstract

Human rights are sacred and inalienable for every individual and every citizen. Nonetheless, not all human rights are absolute. In fact, some human rights can be subject to limitations in particular circumstances where the State can impose some measures to restrict certain rights to protect national security, public order, social morality and other’s rights and freedoms. This article makes an in-depth analysis of the derogation or restriction of human rights and freedoms in accordance with international standards and its application in cyberspace in Vietnam today. The author proposes some solutions and recommendations for the improvement of institutions and laws, aligning them with international standards on derogation and fulfilling the requirement for respecting and ensuring human rights under the socialist rule-of-law state as Vietnam enters a new era of growth and development.
